Patent protection for the combination use of uric acid

in stroke treated with rescue mechanical thrombectomy

Acute ischaemic stroke (AIS) is a chronic non-communicable disease that represents the second leading cause of death worldwide and the most frequent cause of permanent disability. About 1.20 million strokes occur each year in the EU, and about 25% of men and 20% of women can expect to suffer a stroke if they live to be 85 years old. There are two main types of stroke: ischaemic and haemorrhagic. Ischaemic stroke is caused by blood flow restriction in an artery, while haemorrhagic stroke results of the rupture of an artery.

Previous Phase IIb clinical trial URICO-ICTUS, led by Ángel Chamorro, showed a 6.3% absolute effect size on the primary outcome measure compared with placebo. The administration of uric acid (UA) showed complete safety while revealed an absolute treatment effect size of 2% to 8%, which makes it a ground breaking compound that could be prescribed to patients admitted into all types of hospitals caring for stroke patients. UA have also shown an increase of the efficacy of thrombectomy interventions in stroke patients. Therefore, the next step is to carry out a pivotal Phase III clinical trial to confirm the efficacy of the treatment in a bigger population of stroke patients about to undergo mechanical thrombectomy. The treatment (currently in a TRL#8) should improve recanalization benefits by an innovative, safe, simple and cost-effective approach based on the enhancement of the endogenous antioxidant capacity of the patients.

Our UA-based product offers a more cost-effective and easily available approach compared to alternative strategies. It does not require admission into Intensive Care Units, costly advanced imaging techniques, or expensive endovascular devices, only available in highly specialized stroke centres.

Market data forecast an increase in the number of incident cases of AIS in the US and the five largest European markets between 2012 and 2022. In order to reach that market, CUAT plans use the Gínjol support to both fill a new PCT patent application and freedom-to-operate study that shows whether there would be any patent infringement related to our product. Once filled, FreeOX Biotech S.L, a spin-off from the Hospital Clínic-IDIBAPS and future exclusive licensee of the commercials rights of this patent, will cover the following maintenance costs.

IDIBAPS has applied already to other public programmes in order to complement the support to FreeOX Biotech S.L in activities such as the initial screening of potential investors or the regulatory pathway, until they can sublicense the product to another company within a reasonable timeframe of 3 years. Furthermore, it is expected that FreeOX complements the return via future royalties from the commercialization of the product.

L’accident cerebrovascular isquèmic agut (ACVIA) és una malaltia crònica no contagiosa que representa la segona causa de mort al món i la causa més freqüent de discapacitat permanent. Al voltant de 1,20 milions d’ictus es produeixen cada any a la UE, i s’espera que al voltant del 25% dels homes i el 20% de les dones puguin patir un vessament cerebral si viuen fins als 85 anys d’edat. Hi ha dos tipus principals d’accident cerebrovascular: isquèmic i hemorràgic. L’accident cerebrovascular isquèmic és causat per la restricció del flux sanguini en una artèria, mentre que l’ictus hemorràgic és el resultat de la ruptura d’una artèria.

L’anterior assaig clínic Fase IIb ÚRIC-ICTUS, dirigit per Ángel Chamorro, va mostrar una mida d’efecte absolut del 6,3% en la mesura del resultat primari en comparació amb el placebo. L’administració de l’àcid úric (AU) va mostrar una seguretat total, al temps que va revelar una mida de l’efecte absolut del tractament de 2% a 8%, el que el converteix en un compost trencador que es podria prescriure als pacients admesos en tots els tipus d’hospitals que atenen pacients amb AVC. L’AU també han mostrat un augment de l’eficàcia de les intervencions de trombectomia en pacients amb accident cerebrovascular. Per tant, el següent pas és dur a terme un assaig clínic pivotal Fase III per confirmar l’eficàcia del tractament en una població més gran de pacients amb accident cerebrovascular a punt de sotmetre a la trombectomia mecànica. El tractament (en l’actualitat en un TRL #8) milloraria els beneficis de la recanalització mitjançant un enfocament innovador, segur, simple i rendible basat en la millora de la capacitat antioxidant endògena dels pacients.

El nostre producte basat en l’AU ofereix un enfocament més rendible i fàcilment disponible en comparació amb estratègies alternatives. No requereix l’admissió a Unitats de Cures Intensives, ni tècniques avançades d’imatge costoses o dispositius endovasculars cars que només estan disponibles en centres de vessaments altament especialitzats.

Les dades del mercat pronostiquen un augment en el nombre de casos d’ ACVIA als Estats Units d’Amèrica i als cinc majors mercats europeus entre 2012 i 2022. Per tal d’arribar a aquest mercat, CUAT té planejat utilitzar el suport de Gínjol per omplir una nova sol·licitud de patent PCT i un estudi de freedom-to-operate que mostri si hi hauria cap violació de patents relacionades amb el nostre producte. Un cop sol·licitada la patent, FreeOX Biotech S.L., una spin-off de l’Hospital Clínic-IDIBAPS i futura llicenciatària exclusiva dels drets comercials d’aquesta patent, s’encarregarà de cobrir les futures despeses de manteniment.

IDIBAPS ja ha aplicat a altres programes públics per tal de completar el suport a FreeOX Biotech S.L. en activitats com ara la selecció inicial de possibles inversors o els processos reguladors, fins que pugui subllicenciar els producte a una altra empresa en un termini raonable de 3 anys. A més, s’espera que FreeOX complementi el retorn mitjançant les regalies futures de la comercialització del producte.
